She didn’t break the law.

The original NY Penal Code read:

§ 245.01 Exposure of a person. A person is guilty of exposure if s/he appears in a public place in such a manner that the private or intimate parts of his body are unclothed or exposed. For purposes of this section, the private or intimate parts of a female person shall include that portion of the breast which is below the top of the areola.

However, The Court of Appeals of New York ruled in 1992 (People v. Santorelli) that exposure of a bare female breast violates this law ONLY when it takes place in a commercial context. (As a practical matter, proper enforcement of this section can be a problem, since local enforcement agents are often unfamiliar with the case law that interprets the statutory language.) This seems to come up about once every two years or so: a woman will be written a ticket or arrested because the cops don’t know the law, and the case is thrown out.
