In other hilarious offbeat news, there were reports yesterday afternoon of a topless woman casually strolling up the Bowery. Two different Twitter followers posted photos. Matt Kosoy spotted the shameless streaker beneath the scaffolding at 185 Bowery, walking at a seemingly brisk pace with pocketbook slung over her right shoulder.

Mere minutes later, Olivia Knoepfel passed her at the corner of Prince Street, and snapped a photo of the resultant police response. Two cops with questions. Our tipster indicated that the woman was issued a ticket for her illicit activities.

Just another day here on the Bowery! Must be something in the ~~alcohol~~ water that’s causing girls to strip on the Lower East Side.

She didn’t break the law.
The original NY Penal Code read:
§ 245.01 Exposure of a person. A person is guilty of exposure if s/he appears in a public place in such a manner that the private or intimate parts of his body are unclothed or exposed. For purposes of this section, the private or intimate parts of a female person shall include that portion of the breast which is below the top of the areola.
However, The Court of Appeals of New York ruled in 1992 (People v. Santorelli) that exposure of a bare female breast violates this law ONLY when it takes place in a commercial context. (As a practical matter, proper enforcement of this section can be a problem, since local enforcement agents are often unfamiliar with the case law that interprets the statutory language.) This seems to come up about once every two years or so: a woman will be written a ticket or arrested because the cops don’t know the law, and the case is thrown out.
